The time the State has to file a charge depends on the offense named in the charge, and some offenses have no time limit at all. Online cases add date questions, because a message, image, or account record can carry its own date. This page explains the framework under Texas law. It does not say whether any specific charge is still open.

The Short Answer: Texas Sets Filing Limits by Offense

Texas sets a filing period for each offense, so the offense name matters most. Some sex offenses have no limitation period, while others carry a set number of years. Aggravated offenses generally follow the limit of the main crime. Penal Code § 12.03 classifies misdemeanors by the relative seriousness of the offense into three categories and does not state a limitation period for aggravated offenses; that rule is in Texas Code of Criminal Procedure art. 12.03. That is why reading the exact charge matters.

If an old online message has you wondering whether the State can still file charges, we invite you to talk with us in a confidential free initial consultation, with no obligation to continue. Texas Penal Code § 12.01 does not list felony periods; it provides that a person adjudged guilty of an offense shall be punished in accordance with that chapter and the Code of Criminal Procedure. Under Code of Criminal Procedure art. 12.01(1)(C), a sexual assault has no limitation period when biological matter collected in the investigation has not yet been subjected to forensic DNA testing, or has been tested and the results show that it does not match the victim or any other person whose identity is readily ascertained. Under Art. 12.01(1), a sexual assault has no limitation period when probable cause exists to believe that the defendant committed the same or a similar sex offense against five or more victims. Outside those grounds, sexual assault is subject to the limitation periods in art. 12.01, except as provided by Subdivision (1) or (10) of that article. Art. 12.01 lists no limitation for sexual assault under Section 22.011(a)(2), Penal Code, or aggravated sexual assault under Section 22.021(a)(1)(B), Penal Code, and two years from the date the offense was discovered for sexual assault punishable as a state jail felony under Section 22.011(f)(2), Penal Code.

Texas Penal Code § 12.01 does not compare limitation periods for felonies; it provides that a person adjudged guilty of an offense shall be punished in accordance with that chapter and the Code of Criminal Procedure. Felony indictments for aggravated assault may be presented only within five years from the date the offense was committed. A felony the statute does not list separately must be charged within three years. Texas Penal Code § 12.02 designates offenses only as felonies or misdemeanors; the general limitation period for misdemeanors is set by Texas Code of Criminal Procedure art. 12.02, not by that section, and art. 12.02(b) allows three years for assault under Section 22.01, Penal Code, punishable as a misdemeanor and committed against a family or household member. Under Texas Code of Criminal Procedure art. 12.06, an indictment counts as “presented” when the grand jury acts on it and the court receives it. Look for that date on your paperwork.

Why Online Sex Crime Cases Raise Date Questions

Online cases often involve more than one date. A case can turn on when a message was sent, when an image was shared, when an account was used, and when the conduct was reported. Each date can matter, depending on the offense. Reports reach investigators in several ways. The National Center for Missing & Exploited Children CyberTipline states that suspected online child exploitation may be reported, and that NCMEC reviews tips and refers them to law enforcement for possible investigation. A complaint can reach police long after a message was sent.

The offense name also sets the grade. Online solicitation of a minor can be charged as a felony of the second or third degree, depending on the conduct and the minor’s age. Soliciting a minor online to meet for sexual contact is a second-degree felony. Under Texas Penal Code § 21.16, unlawful disclosure of intimate visual material is a state jail felony. These grades differ, so different periods can apply. Device and platform records also carry timestamps, and those may not match memory.

Exceptions and Periods That Are Not Counted

Some time is not counted toward the limit. Under Texas Code of Criminal Procedure art. 12.05, time the accused is absent from the state is not computed in the period of limitation. Time during the pendency of an indictment, information, or complaint is also not computed. Pendency runs from the day the charge is filed until a trial court finds it invalid for any reason. Texas Penal Code § 12.04 classifies felonies by relative seriousness into five categories; the exclusion of the day the offense was committed and the day the charge is presented is in Texas Code of Criminal Procedure art. 12.04.

Discovery dates matter for some offenses. Felony indictments for sexual assault punishable as a state jail felony may be presented only within two years from the date the offense was discovered. So the discovery date, not the act date, can be the starting point. Each exception is tied to statutory language. A rule that fits one offense may not fit another.

Why You Should Not Assume a Charge Is Time-Barred

Many online articles give one number of years for every sex crime. That number can be wrong for the charge you face. The right period depends on the offense, its grade, any discovery rule, the presentment date, and any time the law does not count. Assuming a charge has expired can lead to decisions made on bad information, such as speaking with investigators without understanding the timeline.

The law also changes. Section 43.26 of the Texas Penal Code includes text as amended by Acts 2025 under H.B. 1778 and under S.B. 1621. Earlier versions said something different. Section 43.26 states that several subsections were repealed by Acts 2025 (S.B. 1621), effective September 1, 2025.

What to Bring to a Timeline Review

A review moves faster with the right papers. Bring:

Any charging papers, arrest records, bond papers, and notices, with their dates.

A written list of the dates you know, including messages, posts, account activity, and device use.

Dates of any contact with police or investigators.

The offense names printed on each document, since each name points to a different rule.

If you are unsure of a date, write it down and mark it as uncertain. That helps the review.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

How Barbieri Law Firm Reviews the Timeline With You

Heather Barbieri is the lawyer at Barbieri Law Firm in Frisco, Texas.
