For an online sex crime arraignment in Collin County, it usually comes after the arrest, jail booking and an early hearing before a magistrate.

If you are reading this, a family member or someone you care about may have just been charged. The court date may be close, and the process can feel confusing and frightening. This guide explains each step in plain language, including what happens in the courtroom and what decisions come up.

What an arraignment is in a Texas criminal case

An arraignment is the first formal court appearance where the defendant is told the charges in the case. It is the point where the case formally moves forward in court, so the defendant knows what the state says they did.

The arraignment is separate from the magistrate hearing that usually comes first after arrest. Speaking with a criminal defense lawyer early can help you understand what happens at this stage.

Online sex crime charges can rest on several different statutes. Texas Penal Code § 33.021 covers online solicitation of a minor. It applies to messages sent over the Internet, by email, by text, or through a commercial online service. For the broader picture, read our online sex crimes defense guide.

If a family member was just charged online and the court date is close, you don't have to sort this out alone. First, the person is arrested. Next, they are booked into the county jail. Then a magistrate reviews the case, and the court sets a later date for the arraignment.

The magistrate stage matters more than many families expect. At the first appearance after arrest, a magistrate can issue an order for emergency protection in some cases. Texas Code of Criminal Procedure art. 17.292 allows this for certain offenses, including family violence. Under Art. 17.292(j), an order for emergency protection takes effect when it is issued, and the magistrate or the magistrate’s designee is required to provide the defendant with a copy, either in person or electronically.

Bond amounts and conditions are often set before the arraignment. So the family may see the jail process first, while the court steps come later. A person who is released may have more time to gather records and talk with a lawyer. A person still held may face a more urgent timeline.

Many of these cases start with a report. The NCMEC CyberTipline accepts reports of suspected online enticement and child sexual abuse material. NCMEC reviews those tips and refers them to law enforcement agencies for possible investigation.

Who is in the courtroom and how the docket moves

The judge presides over the hearing. A prosecutor represents the State, and a court clerk keeps the court record. The defendant is present, and any defense lawyer appears alongside them.

Courts often call cases in groups from a docket, which is the court’s list of matters for that day. The wait can be long, and cases are not always called in the order people expect. Plan for a long morning or afternoon.

Arrive early so you have time for security screening. Dress respectfully and bring the court notice, a photo ID and the bond papers. Silence your phone before you enter. Family members often can sit in the courtroom for open hearings, but each court sets its own rules. Follow the notice and any posted instructions.

The charges, the plea, and why a plea is not decided on the spot

At arraignment, the defendant hears the charge and enters a plea. Each choice has real effects, so it is not made lightly.

The charge sets the possible penalty. Under Texas Penal Code § 33.021, a message offense under subsection (b) is a third-degree felony. It becomes a second-degree felony if the minor is younger than 14, or if the actor believes the minor is younger than 14 at the time of the offense. Soliciting a minor to meet for sexual contact under subsection (c) is a second-degree felony.

Under § 33.021, an offense under subsection (b) is a felony of the third degree, except that it is a felony of the second degree if the minor is younger than 14 years of age or the actor believes the minor is younger than 14 at the time of the offense. Under Texas Penal Code § 12.34, a third-degree felony is punished by 2 to 10 years in the Texas Department of Criminal Justice. A fine of up to $10,000 may also apply, as set out in Texas Penal Code § 12.34. Facts such as the minor’s age, whether the conduct was a message or a proposed meeting, and whether it happened during school hours can change the charge. Under § 33.021, the punishment is increased to the next higher category if it is shown at trial that the offense occurred during regular public or private primary or secondary school hours and that the actor knew or reasonably should have known the minor was enrolled in a school at the time of the offense.

A plea decision usually follows a review of the charging papers and the evidence with a lawyer. Lawyers often ask the court for more time so the evidence can be reviewed first.

Bond conditions in online sex crime cases

A judge can set conditions of release, and those conditions vary from case to case. They may limit contact, travel, or other activity. The judge chooses the terms, so the written order controls.

Breaking a bond condition can be a separate crime. Texas Penal Code § 25.07 covers bond conditions related to the safety of a victim or the community in family violence, sexual assault or abuse, indecent assault, stalking, and trafficking cases, as well as certain protective orders, including emergency protection orders under Article 17.292. Under that section, it is an offense to knowingly contact a protected person in a threatening or harassing manner. It is also an offense to go near places the order describes, such as a protected person’s home or a school a protected child attends.

The statute treats contact through the person’s attorney differently from direct contact. Direct contact can violate an order that bars all communication. Contact through the attorney, or a person the court appoints, does not violate an order that bars all communication, but a threat sent through any person to a protected individual or a member of the family or household is still an offense.

Write down every condition and the date it was set. Keep the bond papers with you. Review them with a lawyer before the next court setting.

Protecting yourself between the arraignment and the next court date

Between court dates, keep all contact about the case away from the complaining person, their family, and social media. A message, post, or comment can later become evidence.

Do not delete messages or accounts without first talking with a lawyer. Deleting material can create serious problems of its own. Statements made to police or to others after an arrest can also be used later, so direct any questions about the case to a lawyer.

Keep one folder with every court paper, bond document, notice, and court date. Copies make it easier to review the terms before each setting.

Texas also gives rights to victims. Information about crime victims’ rights is available from the Texas Attorney General’s crime victims’ rights information. Knowing this helps explain why the complaining person may receive case notices.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

How the next court dates and the case timeline unfold

After arraignment, a case can move through pretrial settings, the exchange of evidence, possible negotiations, and a trial setting.
