The risk starts when the other person is, or is believed to be, younger than 17.

The Short Answer: When Fantasy Chat Becomes a Texas Charge

Whether online messages between two adults fall under Texas law on online solicitation of a minor depends on the specific facts, the messages exchanged and the surrounding context. The risk starts when the other person is, or is believed to be, younger than 17.

Many people assume a fictional chat is harmless because no real child is involved. Texas law looks past that assumption. Under Texas Penal Code § 33.021, a “minor” includes someone the actor believes to be younger than 17. So the defendant’s belief about age matters.

This page offers general information about this area of criminal law. It covers what counts as sexually explicit, how age statements become evidence, how chat logs are used, and what usually follows a charge. It is general information, not advice about any one case.

Understanding Online Sex Crime Charges in Texas

Section 33.021 makes it a crime to use the internet to communicate sexually with a minor, or to set up a meeting with a minor for sex. Two parts do most of the work. Subsection (b) covers a person age 17 or older who, intending to commit a listed offense, communicates in a sexually explicit manner with a minor or sends sexually explicit material to one. Subsection (c) covers a person who knowingly asks a minor to meet another person, intending that sexual contact or intercourse follow.

The statute defines “sexually explicit” broadly. It means any communication, language, or material, including a photo or video, that relates to or describes sexual conduct. A text, a chat message, or an image can all fit that definition.

The meeting does not have to happen. Under § 33.021(d), it is not a defense to subsection (c) that the meeting did not occur. The focus is on the messages and the intent behind them.

The Texas Attorney General’s Cyber Safety initiative offers Texas-specific information on online solicitation of minors.

Does Adult Role-Play or Fantasy Chat Count?

The law turns on whether the other person is, or is believed to be, a minor. Adult sexual role-play with no minor involved does not fit that core.

Fantasy framing does not change the analysis when the scenario itself claims a minor’s age. Three common examples show why:

A fictional persona. The user writes as a character, but the character is described as 15 or 16.

A profile with a stated age. A profile lists an age under 17, even if the user later calls it a joke.

A school storyline. A “teacher and student” or “classroom” scene places the character in school.

Each of these can raise the belief question. The statute asks what the person believed about the other party’s age. Every case depends on its own facts.

How Age Statements and Profile Details Create Risk

A stated age, a school reference, a grade level, or a photo can each become evidence of what a person believed. Investigators and prosecutors look at the whole conversation, not one message alone. A line that reads as fantasy on its own can read differently next to earlier messages about school or a birthday.

Timing matters too. Someone who was told the other person was an adult may still face questions about what they believed when the chat happened. Learning the truth later does not change what the person believed at the time.

The statute also adds punishment in some situations. Subsection (e) also lists two defenses to subsection (c). One applies when the actor was married to the minor. The other applies when the actor was not more than three years older than the minor and the minor consented.

How Chat Logs, Texts, and Device Data Become Evidence

Chat logs and text messages are often the core evidence in these cases. They show what was said, when it was said, and in what order. Investigators usually read them in full context, so the timeline matters as much as any single line.

Other records can also come into play. Account information, internet records, and the contents of a phone or computer may be used. Many of these cases begin with a report. The NCMEC CyberTipline accepts reports of suspected online child exploitation. The National Center for Missing & Exploited Children reviews those tips and refers them to law-enforcement agencies for possible investigation. The Internet Crimes Against Children Task Force Program addresses the federal program’s role in investigating technology-facilitated child sexual exploitation.

Police may ask a person to unlock a phone. A lawyer can explain that request before anyone responds to it.

What Usually Happens After a Texas Charge Is Filed

A case usually moves through an investigation, a possible arrest, an arraignment, bond conditions, and a review of the State’s evidence. Each case moves at its own pace, and the timing can change as evidence comes in.

Grading matters. It becomes a second-degree felony if the minor is younger than 14, or if the actor believes the minor is younger than 14. An offense under subsection (c) is a second-degree felony.

The consequences can last beyond a sentence. A conviction can therefore carry registration duties and other lasting effects.

Practical Steps While You Are Still Researching

Stop messaging the other person. Do not contact anyone connected to the chat about the matter. Those contacts can create new questions about what was said and why.

Don’t delete messages, reset a device, or close accounts before talking with a lawyer. Changing data can create separate problems. Keep a private written timeline of the conversation, and label it as written for your lawyer.

A lawyer can review the actual messages, the stated ages, and the timeline. From there, the lawyer can explain what the State may argue and what questions it will need to answer.

Talk With Barbieri Law Firm About Your Situation

If you are looking into this for a spouse, child, or friend, or because a message has you worried, you do not have to sort it out alone. The offense focuses on the messages and intent.

Can a stated age in a fictional persona be used as evidence? Yes, it can be used to show what a person believed about the other party’s age. That is why a fantasy chat online solicitation charge Texas case often turns on the messages themselves.

Does a charge go straight to a conviction? Every case depends on its own facts, and an attorney can review the evidence and explain the options.

Attorney responsible for this site: Heather Barbieri, Barbieri Law Firm, Frisco, Texas.

Barbieri Law Firm, 17 Cowboys Way, Suite 175, Frisco, TX 75034.
