In a Texas sex crime case, the accused usually weighs three paths: a plea to a reduced charge, a plea that leads to deferred adjudication, or a trial. This page explains each of these plea bargain sex crime Texas options. It covers what each path involves, what it can change, and what it cannot change. Use it as a map, then compare it with the facts of your own case.

What a Plea Bargain Is in a Texas Sex Crime Case

A plea bargain is a negotiated agreement between the prosecutor and the defense. The accused agrees to plead to an offense or to certain terms. In return, the State gives up something, such as a lesser charge or a recommended sentence.

The judge is part of the process too. A deal is not final until the court acts on it.

The charge matters a great deal. Texas defines each sex offense separately, and each one carries its own range of punishment. Penal Code § 22.011 defines sexual assault. Penal Code § 22.021 defines aggravated sexual assault. Penal Code § 21.11 covers indecency with a child. Penal Code § 33.021 covers online solicitation of a minor.

Each path below starts from that charge.

If a prosecutor's offer is on the table in your case, we can review what accepting, rejecting or going to trial would mean for your record and your daily life. The strength and type of evidence matters. So do the charged offense and its penalty range. The accused’s prior record counts, and so does digital or forensic evidence, such as messages, recordings, or lab results.

The complainant’s views are part of the process. Those rights do not decide the case on their own.

A prosecutor who is willing to talk is not telling you how the case will end. An offer is a starting point for review, not a forecast.

Reduced Charges: Pleading to a Lesser or Different Offense

A reduced charge means the accused pleads to a different or lesser offense. That offense carries a different range of punishment.

The offense of conviction matters for registration. Texas Code of Criminal Procedure Art. 62.001 defines the offenses that count as sexually violent or reportable. Those definitions list sexual assault, aggravated sexual assault, and indecency with a child. They also list online solicitation of a minor as a separate item. A plea to a different statute can change your registration duties, so check that before you agree.

Some lesser offenses are state jail felonies. Under Penal Code § 12.44, a court may impose confinement allowed for a Class A misdemeanor. The court must find that this serves the ends of justice, after weighing the offense and the defendant’s history and rehabilitative needs. When the prosecutor asks, the court may also allow prosecution as a Class A misdemeanor.

Grading matters in online cases too. Under § 33.021, the grade depends on the subsection and the minor’s age. A minor under 14 raises the grade.

Before you accept a reduced charge, check its grade, its registration result, and its effect on work, school, and immigration status if you are not a citizen.

Deferred Adjudication: What It Is and What It Does Not Change

Deferred adjudication means the judge delays a finding of guilt and places the accused on community supervision with conditions.

The judge can do this only after a guilty or nolo contendere plea and a hearing where the evidence supports guilt. The judge must also find that it serves the interests of society and the defendant. See Texas Code of Criminal Procedure Art. 42A.101.

Finishing supervision can lead to dismissal. Under Art. 42A.111(a), if the judge has not adjudicated guilt when the period ends, the judge must dismiss and discharge the defendant.

Early discharge has a limit. A judge may not end supervision early for an offense that requires registration under Chapter 62, under Art. 42A.111(b). The registration question must be answered before you plead.

A discharge is not treated as a conviction for many legal disqualifications, under Art. 42A.111(c). A prior deferred adjudication can still matter, though. If a later case ends in conviction, the court can consider it on punishment, under Art. 42A.111(d)(1).

Eligibility has limits. For sexual assault, aggravated sexual assault, or indecency with a child, the judge must find in open court that deferral serves the victim’s interests. Some aggravated sexual assault charges cannot be deferred at all, including those punishable under Subsection (f) of § 22.021. See Art. 42A.102.

If the court later adjudicates guilt, proceedings continue as if guilt had not been deferred, including appeal. See Art. 42A.110(a).

Can a Felony Charge Be Dropped in Texas?

A felony charge can be dismissed. The State or the court makes that call, not the defense lawyer.

In some cases, a court can dismiss a case as Texas law permits. Whether that happens turns on the evidence and how the case develops.

A dismissal is different from an acquittal. An acquittal is a not-guilty finding at trial. A dismissal ends the case without that finding.

A dismissal after deferred adjudication is a separate path. Under Art. 42A.111, the proceedings end in dismissal and discharge when supervision expires without adjudication.

Do not assume a dismissal is coming. Prepare the case as though it will be contested. That is the only way to keep every option open.

What Happens If You Plead Guilty to a Felony in Texas

A guilty plea leads to a conviction or a deferred order, depending on how the judge rules.

Before deferral, the judge must hear the evidence and find that it supports guilt. The judge must also tell the defendant the possible consequences of violating supervision. The judge can give that warning orally or in writing.

Immediate consequences depend on the path. Deferred adjudication carries supervision with conditions, and a violation can lead to adjudication. Registration duties may follow, depending on the offense.

Collateral consequences often matter as much as the sentence. These can include firearm limits, housing, employment, and professional licensing. Texas limits how a dismissed offense can be used to deny or revoke a license.

For non-citizens, a plea can carry immigration consequences. That question needs its own review before any plea.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Going to Trial: The Alternative to a Plea

The judge or jury decides whether it has.

Trial preparation includes pretrial motions and a review of every piece of evidence. In sex crime cases, that often means recordings, messages, phone data, and forensic results. It also means preparing for testimony.

Trial carries sentencing exposure. Aggravated sexual assault under Penal Code § 22.021 is a first-degree felony.

A trial result cannot be predicted. Going to trial does not mean a conviction.

Who Makes the Decision and How It Is Made

The accused decides whether to accept an offer, reject it, or go to trial. That decision is made after advice from counsel.

Useful advice explains the exact terms in writing. It covers the range of punishment, the registration and collateral effects, and what the State’s evidence shows. It also lays out the realistic options at trial.

No lawyer can predict or assure the outcome on any path. Every choice carries risk, including the choice to reject an offer.

The right choice turns on the specifics of each case. Do not rush a decision before the evidence has been reviewed. Ask for time to review recordings and other material. Every one of the plea bargain sex crime Texas options deserves that review.

Questions to Ask Before Deciding on a Plea Offer

Before you accept any plea offer, get clear answers to a few core questions:

What exact offense would I plead to, and under which statute?

Is that offense reportable or sexually violent under Chapter 62?

Is the plea a final conviction or deferred adjudication?

How long is supervision, and what happens if I violate a condition?

Has every recording, message, and lab result been reviewed?

How would this affect my job, license, housing, family, firearms, and immigration status?

Frequently asked questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What are my plea bargain sex crime Texas options?

The main options are a plea to a reduced charge, deferred adjudication, or a trial.
