An accusation is not proof, though.

If you searched for someone used my account online sex crime charge Texas, you’re probably worried about one thing. Does your name on the account settle the question? It does not. Account ownership is one piece of evidence. It is weighed with other facts, such as who had access, where the device was, and when the messages were sent.

Texas defines possession broadly. Control of a shared phone or computer is a factual question. A review asks who actually had that control at the time of each message.

This page explains how attribution works in general. It does not predict how any particular case will be resolved.

Texas Laws That Come Up in Account-Misuse Cases

One statute in these cases is online solicitation of a minor. It covers messages sent over the internet, by email, by text, or through a commercial online service.

Subsection (b) covers sexually explicit communication with a minor, or sending explicit material to a minor, when the person intends to commit a listed offense. Subsection (c) covers knowingly soliciting a minor to meet another person for sexual contact or intercourse. A “minor” includes someone the actor believes is under 17, not only someone who actually is.

The meeting does not have to happen. The statute says it is not a defense that the meeting did not occur. The offense level also matters. A subsection (b) offense is a third-degree felony, or a second-degree felony if the minor is younger than 14 or the actor believes so. A subsection (c) offense is a second-degree felony.

Other laws can apply too. Texas Penal Code § 21.19 covers knowingly sending, by electronic means, visual material that shows sexual conduct or intimate parts. It applies when the recipient did not request the material or give express consent. That offense is a Class C misdemeanor.

The exact charge depends on the messages, the recipient’s age if known, and what the State alleges. For a broader view, read the online sex crimes defense guide.

How Investigators Try to Tie an Account to One Person

Investigators look for links between an account, a device, a network and a time. Several kinds of records can build those links.

Account records: who registered the account, and which phone number or email is attached.

IP addresses and timestamps: which internet connection a session used, and when.

Login history: which devices signed in, from where, and whether new devices were added.

Recovery details: phone numbers, recovery emails and two-step verification settings tied to the account.

Device examination: a phone or computer may be searched for saved messages, browser sessions and app data.

Reports can start the process too. Suspected online child exploitation can be reported to the NCMEC CyberTipline, which reviews tips and refers them to law enforcement for possible investigation. Federal task forces also investigate technology-facilitated child sexual exploitation through the Internet Crimes Against Children Task Force Program.

Each record shows something and leaves something out. An IP address can point to a home connection. It does not show who sat at the keyboard.

Shared Computers, Phones and Saved Logins

A shared device left signed in can let another person send messages from your account. The account owner may never open that app on that day.

Common situations include a family computer, a shared tablet, a roommate, a visitor, or a child with access to a phone. Saved passwords, autofill and open browser sessions make it easy to send messages without typing a login.

Shared family, streaming and gaming accounts can also have several users. More than one person may have signed in on different devices.

Start a simple list now. Write down everyone who had access to each device and account, and when. That list is one of the first things a defense review compares with the records. Keep it private and share it with your lawyer.

Hacked, Phished and Compromised Accounts

Yes, an account can be taken over. A takeover often leaves traces in the account’s own records.

Common routes include reused passwords, phishing messages that ask for a login, malware on a device, and stolen session cookies that keep a browser signed in. Each route can let someone else control the account without the owner knowing.

Look at the login history for sign-ins from unfamiliar cities, browsers or devices. Check for security alerts the provider sent you. Notice whether the recovery email or phone number changed, or whether two-step verification was turned on or off.

Keep provider notices and any report you made to the platform. Do not delete them. They can be relevant records.

What a Defense Review of Attribution Looks At

A defense review tests whether the records point to you or to someone else. It usually checks six areas.

Device access: who could reach each device, and whether a passcode or biometric lock protected it.

IP records and location: whether the addresses match your home, your work, or another person’s address.

Login times: whether the sessions line up with your documented schedule, calls, texts and location data.

Account setup: when the account was created, and which phone number and email it uses.

Message content: the language, names, spelling and details, and whether they match how you usually write.

Forensic exam results: whether the messages are on your device, on another device, or only in the provider’s records.

Each area can support one account of events or weaken another. A review looks at all of them together. For how these issues fit into the wider defense, see the online sex crimes defense guide.

Registration and Other Consequences Depend on the Charge

Whether sex offender registration applies depends on the offense and how the case ends. Article 62.001 of the Texas Code of Criminal Procedure defines terms used in this chapter, including “Department” and “Penal institution.” Its definitions list a violation of § 33.021 among the offenses that matter, as shown in Texas Code of Criminal Procedure art. 62.001.

Case outcomes can take different forms. Under Texas Code of Criminal Procedure art. 42A.101, a judge may defer further proceedings and place a defendant on deferred adjudication community supervision. That can happen after a guilty or nolo contendere plea and a hearing that substantiates guilt. The judge decides this only when the judge believes it serves the interest of society and the defendant.

Plea terms, including the offense named and any registration duty, are central to how a case is resolved. Read the plea bargain options guide for more detail. The timeline guide explains how long these cases often take.

Common Questions About Shared-Account Online Charges

Answers to common someone used my account online sex crime charge Texas questions start with one point.
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can I be charged if I never typed the messages?

Yes, a charge can name you.
