Subsection (b) addresses sexually explicit communication with a minor, or sending sexually explicit material to a minor. Subsection (c) addresses knowingly soliciting a minor to meet another person for sexual contact, sexual intercourse, or deviate sexual intercourse.

The statute also sets grades. An offense under subsection (b) is a third-degree felony. It becomes a second-degree felony if the minor is younger than 14, or if the actor believes the minor is younger than 14. An offense under subsection (c) is a second-degree felony.

Statutes can be amended. Wording and penalty levels can change.

Element One: An Electronic or Other Communication

The State must show the accused communicated through an electronic channel. The statute names the Internet, email, text message, other electronic message systems, and commercial online services.

Prosecutors typically rely on message logs, timestamps, screenshots, platform records, and device extractions. Each one answers a different question. Does the message exist? When was it sent? Where did it come from?

The harder question is often which account or device produced the message. If a shared family computer, a borrowed phone, or a shared app login was involved, the source of each message becomes a central issue. Those facts can change the whole case, so they belong at the top of the review list.

Element Two: The Required Intent

The statute ties the communication to sexual conduct. For these purposes, “sexual contact” means touching the anus, breast, or any part of the genitals of another person with intent to arouse or gratify sexual desire, as Texas Penal Code § 21.01 defines it. Section 33.021 borrows that definition.

Intent is a mental state.

Prosecutors often try to prove intent from the words used, the context of the conversation, and the requests made. The full conversation matters. What came before a disputed message, and what came after, can change how a reader understands it.

A paraphrase is not enough. The exact text of each message needs review. A joke, a misunderstood phrase, or a reply taken out of order can read very differently in full context.

Element Three: The Minor, or the Accused’s Belief About Age

Under the statute, a minor is a person younger than 17. A minor also includes a person the actor believes to be younger than 17.

That second part matters. The statute reaches what the accused believed, not only what was true. That makes the question of who the accused thought they were talking to central in many cases.

Many Texas cases involve an undercover officer or an adult posing as a teen. Profile details, stated ages, photos, and the platform used are the kinds of evidence that bear on what the accused knew or believed.

Do not assume an age is established because a profile or message says so. A stated age is evidence to test, not a conclusion.

Element Four: The Solicitation Itself

The offense requires a specific kind of communication. Under subsection (b), the State must show a sexually explicit communication or the distribution of sexually explicit material. Under subsection (c), the State must show a knowing solicitation to meet for sexual conduct.

The statute defines “sexually explicit” as any communication, language, or material, including a photo or video, that relates to or describes sexual conduct. The exact words and requests matter, because the State must tie them to the prohibited conduct.

Charging language matters too. The charge may be framed around a request, an invitation, or explicit content. The charging document tells you which theory the State is pursuing. Compare that language with the messages the State has produced.

Section 33.021(d) adds that it is not a defense to a subsection (c) charge that the meeting did not occur. The solicitation itself can be the focus.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Who the State Must Connect to the Messages

Proving that a communication happened is different from proving the accused typed it.

Common attribution issues include shared passwords, shared devices, a second person with access to the account, and an account used by someone else.

Prosecutors often use forensic records, IP information, login history, and device ownership to link an account to a person. Those records can support the State’s theory or weaken it. They need careful review.

Preserve every device, account, and record connected to the case. Do not delete messages. Do not contact the other party about the messages. Those steps can create new problems. Write down what you remember, and keep it private for your lawyer.

Where These Cases Are Often Contested

Each element can be tested separately. The State must prove the communication, the intent, the age relationship, the solicitation, and the link to the accused.

A defense lawyer commonly examines the full message history, the age evidence, the account records, the timeline, and how police obtained and preserved the evidence. Gaps in any of these areas can matter.

Entrapment is another area to examine. Under Texas Penal Code § 8.06, it is a defense if a law enforcement agent induced the conduct using persuasion or other means likely to cause persons to commit the offense. Merely giving a person an opportunity to commit an offense is not entrapment.

Whether any of these issues matters, and how, depends on the facts of the specific case. No summary can predict how a case will end.

Related Questions Once a Charge Is Filed

Once a charge is filed, several questions come up. Readers often ask about the overall structure of sex crime defense in Texas, whether someone else used the account, and how long a case can take.

Reports to the National Center for Missing & Exploited Children are one way these cases begin. The NCMEC CyberTipline accepts reports of suspected online child exploitation, including online enticement, and refers tips to law enforcement for possible investigation. A tip is a starting point for an investigation, not proof of a crime.

Federal investigations can run alongside state charges. Texas law also lets prosecutors pursue the same conduct under another law. Section 33.021(g) states that the actor may be prosecuted under this section, the other law, or both.

Ask your lawyer which related questions apply to your facts. Each one turns on the charging papers and the evidence.

Talk Through Your Situation With Heather Barbieri

You may be reading this because a police officer, a family member’s phone, or a court notice put a Texas online solicitation charge in front of you. The exact elements depend on the subsection charged.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Does the state have to prove the other person was actually a minor?

No. Texas law covers messages sent to a person the accused believed was a minor, so the state does not have to prove a real child was involved. Prosecutors often rely on the wording of the messages, their timing, and the surrounding context to show that intent.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Does the state have to show that a meeting or sexual contact actually happened?

The online solicitation offense focuses on the electronic communication and the intent behind it, so a meeting or physical contact does not have to occur for the charge to apply.
