What an Online Sex Crime Charge Against a Teacher or Coach Means<\/h2>\n

An online sex crime charge is an accusation, not a conviction. Texas Penal Code \u00a7 33.021<\/a> covers online contact with a minor. Under subsection (b), a person who is 17 or older commits an offense by using the internet, email, text, or an online service to communicate in a sexually explicit manner with a minor, or by sending sexually explicit material to a minor, with the intent to commit certain sexual offenses listed in Article 62.001(5), Code of Criminal Procedure. Subsection (c) separately covers soliciting a minor to meet for sexual contact, and it has no age-17 element.<\/p>\n

School employees face a separate offense. Texas Penal Code \u00a7 21.12<\/a> covers this conduct with a student enrolled at the school where the employee works. The student’s age does not change that.<\/p>\n

Accusations often start with a student, a parent, a platform report, or a police investigation. The NCMEC CyberTipline<\/a> accepts reports of suspected online enticement and refers them to law enforcement. Some cases also involve the ICAC Task Force Program<\/a>, which investigates technology-facilitated child sexual exploitation.<\/p>\n

What the State Must Prove in an Online Case<\/h2>\n

Online cases turn on three questions: what was said, who said it, and what the person intended. The communication offense requires intent, so evidence of purpose matters. The Texas Attorney General’s cyber safety resources<\/a> describe the online conduct Texas prohibits.<\/p>\n

The statute defines a minor as someone under 17, or someone the actor believes is under 17. Because that definition turns on what the accused believed, the other person’s actual age is not the only question in these cases.<\/p>\n

Who operated an account or device is often central. Shared phones, logins, and computers raise separate questions. The state’s messages and timestamps are evidence to test, not facts to accept.<\/p>\n

Penalties are serious. Solicitation to meet a minor is a second-degree felony under \u00a7 33.021<\/a>.<\/p>\n

Defenses exist. Under the same statute, it is not a defense that the meeting never happened. Entrapment is a defense when a law enforcement agent induces the conduct, but giving someone an opportunity to offend is not entrapment, under Texas Penal Code \u00a7 8.06<\/a>.<\/p>\n

Why the School Response Starts Before the Case Ends<\/h2>\n

The school and the criminal case run on separate tracks. A district may open its own investigation, place an employee on leave, or report the accusation to the Texas Education Agency or police. Each step can affect the other.<\/p>\n

Statements matter. What you tell a principal, HR office, or coworker can be repeated later. Review likely questions with counsel first, including what happened, who you spoke with, and what messages you sent.<\/p>\n

Bond conditions can restrict contact. In some family violence and sexual assault related cases, Texas Penal Code \u00a7 25.07<\/a> makes it an offense to communicate with a protected person when the order prohibits all contact, except through your attorney or a court-appointed person.<\/p>\n
