Certain facts raise the charge to a first-degree felony, with 5 to 99 years or life. This page explains those ranges, what they mean, and where the numbers come from.

If you’re reading this because you’ve been charged, or because someone you love has, the numbers can feel heavy. Let’s take them one at a time.

What makes an assault “aggravated” under Texas law?

An assault becomes aggravated when it causes serious bodily injury or involves a deadly weapon. Under Texas Penal Code § 22.02, a person commits aggravated assault by committing an assault and either causing serious bodily injury to another, including a spouse, or using or exhibiting a deadly weapon during the assault.

The word “assault” alone doesn’t tell you the penalty. The added element raises the offense, and the charge level sets the range. The facts of the alleged incident decide which part of the statute applies, so the charging papers matter from the start.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What is the base penalty for aggravated assault in Texas?

The base penalty for aggravated assault is a felony of the second degree under Texas Penal Code § 22.02. Under Texas Penal Code § 12.33, a person convicted of a second-degree felony shall be punished by imprisonment in the Texas Department of Criminal Justice for a term of not less than 2 years and not more than 20 years, and may also be punished by a fine. Harris County’s felony summary describes aggravated assault the same way.

That range is the limit the law sets. It is not an average, and it is not a forecast for any one case.

Probation may be possible. Under Texas Code of Criminal Procedure art. 42A.053, a judge may suspend the sentence and place a defendant on community supervision after a conviction or plea. But art. 42A.054(b) says that rule does not apply when a deadly weapon was used or exhibited during a felony and the defendant used it or knew it would be used. Article 42A.053 also bars supervision for terms over 10 years. So whether probation is an option depends on the facts and the record.

When is aggravated assault a first-degree felony?

Certain listed circumstances raise the offense to a first-degree felony. That carries life or 5 to 99 years in prison.

Under § 22.02(b), one example is using a deadly weapon and causing serious bodily injury to a person in a relationship described in the Family Code. Another is an assault against a person the actor knows is a public servant lawfully doing an official duty. The statute lists more, including assaults tied to retaliation against a witness.

A first-degree felony penalty also allows a fine of up to $10,000. A short summary can leave out a condition that changes the range. Because the range shifts so much, the exact charge matters more than the word “aggravated” alone.

How do misdemeanor penalties compare?

Misdemeanor penalties are smaller, and they are served in county jail, not state prison. A Class A misdemeanor carries a fine of up to $4,000, up to one year in jail, or both, under Texas Penal Code § 12.21. A Class C misdemeanor carries a fine of up to $500, under § 12.23.

The penalty follows the level of the charge filed. A simple assault charge carries a different range from an aggravated one, so the exact wording on your papers matters. In each range, a fine and confinement can be imposed together where the statute allows it. The Texas Attorney General publishes an offenses-by-range document that lists punishment ranges by offense category.

How long would someone stay in jail for aggravated assault?

Felony sentences are carried out through the Texas Department of Criminal Justice. The TDCJ parole information publication describes parole procedures, discretionary release, parole conditions and revocation.

The sentence imposed and the release process are different questions. A range alone can’t tell anyone how long a specific sentence would last. Misdemeanor sentences are served in jail. Felony sentences are served in TDCJ prison.

Can an aggravated assault charge be dropped or reduced?

A charge can be reduced or dismissed in some cases, but no lawyer can promise that result. Those decisions turn on the evidence, the court record and the facts of the incident.

A reduction to a lower level changes the range that applies, which is why the charge level matters so much. Read the charging papers closely and note every date on them. Early review helps you understand each option before decisions are made.

Questions people ask

Is aggravated assault a felony in Texas? Yes. It is generally a second-degree felony, and it is a first-degree felony in certain listed circumstances.

What is the fine for aggravated assault? A fine of up to $10,000 can be imposed with prison time for either felony level.

Can probation be available? Judge-ordered community supervision is possible in some cases, but not when a deadly weapon was used in a felony and the defendant used it or knew it would be used.

Can an aggravated assault charge be dropped? Prosecutors decide whether to dismiss or reduce a charge, and no lawyer can promise that outcome.

If this charge is weighing on you or someone you love, talking through your own facts can help.
