It is a serious charge. A conviction can lead to a prison term of 2 to 20 years and a fine of up to $10,000. Those are limits set by law. They are not a forecast for any one case.

This page explains where those numbers come from, what the range means, and what can change it. It also answers the questions people ask most in the first days after a charge: jail time, probation and mandatory sentences.

What a second degree felony is under Texas law

A second degree felony is a felony graded in the middle of the Texas scale. Texas sorts crimes into misdemeanors and felonies. Felonies are ranked by degree: first, second and third, plus a separate class called state jail felonies. Second degree sits above third degree and state jail felonies, and below first degree.

The grade comes from the offense itself. The Penal Code sets the punishment range for each grade. Texas Penal Code § 12.33 sets the range for second degree felonies. Check the charging papers for the offense and grade alleged. That classification decides which range applies.

Grades do not always match the names people use for a crime. Under Texas Penal Code § 22.02(b), aggravated assault is generally a second degree felony, though certain aggravated assaults under that section are first degree felonies. So an assault charge may carry this range, even if the word “felony” is the only part people remember. Check the offense alleged, which determines the grade.

If a second degree felony charge has you or someone you love reeling, we can talk through the options. The statute says a person found guilty “shall be punished by imprisonment in the Texas Department of Criminal Justice for any term of not more than 20 years or less than 2 years.” The same section allows a fine of up to $10,000 in addition to prison.

A range is a limit. It is not a sentence the court must impose. That choice depends on the facts of the case, the evidence, and the rules that apply.

Some sentences include only prison time. Others include a fine as well. The statute allows both, so a reader should not assume the fine is an either-or choice.

A common mistake is treating the top of the range as the expected result. Twenty years is the maximum the statute allows. It is not a prediction. Reading the range as a forecast can make a frightening situation feel more certain than it is.

How long is jail time for a second degree felony?

The statutory range for a second degree felony is 2 to 20 years of imprisonment. Felony prison time is served in the Texas Department of Criminal Justice, not in a county jail. That is the rule set by Texas Penal Code § 12.33.

Many people search for one number. The range does not give one number. It sets the outer limits of what the law allows, from 2 years up to 20 years.

Two questions often get mixed together. The first is the sentence a court imposes. The second is the time a person actually spends in custody. The range answers only the first question, and only as a limit.

A lawyer reviews the facts, the record and the evidence before talking through the options in a specific case. The paperwork often shapes those first questions, including the offense charged, the grade and any enhancement notice.

Can you get probation for a second degree felony in Texas?

Community supervision, the Texas term for probation, is not always available from the judge. Some offenses and findings make a defendant ineligible for judge-ordered community supervision, including second degree sexual assault, indecency with a child by contact, and cases with an affirmative deadly-weapon finding, which can arise in some aggravated assault cases. A defendant sentenced to more than 10 years is also ineligible.

Under Texas Code of Criminal Procedure Art. 42A.053, a judge may suspend the sentence and place the defendant on community supervision after a conviction or a plea of guilty or no contest. Under Code of Criminal Procedure art. 42A.054(b), a deadly-weapon finding in an aggravated assault case also makes a defendant ineligible for judge-ordered community supervision.

The length of community supervision has rules too. In a felony case, the minimum period matches the minimum prison term for the offense. For a second degree felony, that minimum is 2 years. The maximum is generally 10 years, with a shorter limit for certain third degree felonies.

A judge may not deny community supervision based only on a person’s inability to speak, read, write, hear or understand English. Whether a particular case qualifies depends on the offense and the defendant’s record.

Is jail time mandatory for a felony in Texas?

A second degree felony sentence is a prison range. A judge can sometimes suspend that sentence and order community supervision instead.

Texas Penal Code § 12.33 says a person adjudged guilty of a second degree felony “shall be punished by imprisonment” within the 2 to 20 year range. Article 42A.053 is a separate rule. It lets a judge suspend that sentence in certain cases, as covered above.

Some offenses have their own sentencing rules. Enhancements also change which range applies. The charge-specific statute must be read alongside § 12.33, not in place of it.

Confirm the exact offense and its statute on the charging papers.

How does a second degree felony compare with other Texas offenses?

A second degree felony falls between first degree felonies, which carry much longer ranges, and third degree felonies, which carry shorter ones. Each range comes from the Penal Code.

First degree felony: life, or 5 to 99 years, plus a fine up to $10,000 (Penal Code § 12.32).

Second degree felony: 2 to 20 years, plus a fine up to $10,000.

Third degree felony: 2 to 10 years, plus a fine up to $10,000.

State jail felony: 180 days to 2 years, plus a fine up to $10,000.

A state jail felony can be punished as a third degree felony in some cases. One example is when a deadly weapon was used or exhibited during the offense.

Misdemeanors carry lower ranges:

Class A misdemeanor: a fine up to $4,000, jail up to one year, or both (Penal Code § 12.21).

Class B misdemeanor: a fine up to $2,000, jail up to 180 days, or both (Penal Code § 12.22).

Class C misdemeanor: a fine up to $500 (Penal Code § 12.23).

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Enhancements and factors that can change the range

Prior convictions and certain findings can move a case into a higher range. These rules must be alleged and proved, or pleaded true, to apply, so the record and the charging language matter.

Texas Penal Code § 12.42 covers repeat offenders. If it is shown on the trial of a second degree felony that the defendant has a prior final felony conviction, the defendant is punished for a first degree felony. The statute has exceptions, including certain state jail felonies.

Two prior felony convictions can lead to a much higher range. If the second prior offense occurred after the first became final, the range can be life, or 25 to 99 years. The statute lists exceptions to that rule too.

Penal Code § 12.47 increases the punishment range when the court makes an affirmative finding of bias or prejudice under Code of Criminal Procedure art. 42.014.
