Quick answer: what Texas law says about a false report to police

In Texas, an accusation is not proof. That holds even when someone has reported to police that you committed a crime, and you say that report is false.

A false report can still lead to an investigation, an arrest, bond conditions and a criminal case. This page explains how these cases usually move, what evidence often matters, and what to understand early. Think of it as a plain-language map, not a prediction of how any case will end. No lawyer can predict or assure the outcome of any case.

If a report has you or someone you love worried, you don't have to sort out the next steps alone. Call Barbieri Law Firm at (972) 424-1902 for a free initial consultation. Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

What the charge covers in plain terms

When a report to police leads to a charge, the charge names a specific offense. The cases this page covers include:

  • Sex crimes, such as sexual assault and aggravated sexual assault
  • Child sex crimes, such as indecency with a child or sexual assault of a child
  • Online sex crimes, such as online solicitation of a minor or offenses involving explicit images
  • Family violence, which usually involves an assault alleged against a family member, household member or dating partner

The exact charge matters. Read the charging papers to see the offense named and the grade listed. The grade shapes the possible penalty range.

The elements the State must prove

A charge is only an accusation. Each part of a charge is a question a lawyer can review against the evidence.

In a family violence case, the relationship between the people involved is part of the allegation. In a sex crime case, the State must prove the specific conduct and, in many cases, the age of the person involved.

When you say a report is false, two questions often carry weight. The first is whether the accuser’s account stays consistent over time. The second is whether the rest of the evidence supports or contradicts that account. An accusation that the record does not support may look very different from one the record backs up.

How a false allegation can become a criminal case

Many of these cases start with one person’s statement. Police may arrest someone in a family violence call based on what officers see and hear at the scene. A sex crime investigation may begin weeks, months or years after the events described. In a case involving a child, Child Protective Services and a children’s advocacy center may also be involved.

What a person told police is a question our lawyers can review against the evidence. Some allegations come from a misunderstanding. Others may arise during a divorce, a custody dispute, a breakup or a workplace conflict. The reason behind an allegation is often an important part of the defense review, but it has to be shown with evidence, not assumed.

The evidence that often matters

Several kinds of evidence often show what happened and when. These include:

  • Text messages, emails, social media messages and call logs
  • Phone location data, photos and their timestamps
  • Body camera or dash camera video and 911 recordings
  • Police reports and witness statements
  • Medical records and, in some sexual assault cases, a forensic exam report
  • Recorded forensic interviews in cases involving a child
  • Computer and device records in online cases

Investigators compare these sources against each other. So can the defense. Differences between an accuser’s statements, or between a statement and the digital record, may matter in how the case is evaluated.

Penalties for a false report to police in Texas

People who have been falsely accused often search for the penalties for a false report. That issue is covered below. For the person accused, the penalties that matter are the ones for the charge that was filed.

Penalty ranges depend on the exact charge and the facts alleged. As general examples under Texas law:

  • Aggravated sexual assault is a first-degree felony. The range is 5 to 99 years or life in prison and a fine of up to $10,000.
  • Under Texas Penal Code § 22.02, aggravated assault is a felony of the second degree, except in certain circumstances the statute sets out as felonies of the first degree. Some versions are first-degree felonies.

These are ranges, not predictions. A case can also affect life outside the courtroom:

Many professionals worry about these consequences as much as the sentencing range.

Can you get probation for a false report to police in Texas?

Probation depends on the charge filed against you, not on how the case started. If a report you say is false leads to a charge, the same rules apply as in any other case.

A judge may order community supervision (probation) in some cases. In others, a judge may defer a finding of guilt through deferred adjudication. Whether these options are available depends on the charge. Texas law limits or bars them for some sexual offenses. For some offenses, only a judge, not a jury, may grant them.

Whether any of these options is available depends on the facts of the case and the judge’s decision. No one can promise a particular sentence.

How long the State has to file charges

People often assume an old allegation cannot be charged. For several sexual offenses involving children, Texas law sets no limitations period. An allegation about events from many years ago can still be charged. Other offenses have set time limits, and some time periods are not counted.

Because these rules vary by offense, someone who wants to know the deadline in their own situation should check the exact charge and dates.

Common myths about false police reports

One myth says that if the accuser takes back the report, the case ends.

A second myth says that explaining your side to police will clear things up. Words said in a hurry can be repeated later and read in a different light.

A third myth says that a lack of physical evidence means no charge can be filed. What matters is the full record of what was said, to whom, and when.

If you’re the person accused, or worried about a report

If you’re facing one of these charges, start by learning exactly what the State says you did. Read every charging paper and bond document. Note the offense name, the date, the grade and any conditions you must follow.

Some early steps help:

  • Write down what you remember while it is fresh, including dates, places and who was present.
  • Save messages, call logs, photos and any video you can access. Do not delete anything.
  • Follow every bond condition and any protective order exactly. In family violence cases, a magistrate may issue an emergency protective order after an arrest. Violating it can be a separate offense.
  • Do not contact or pressure the accuser, even to ask them to tell the truth. That contact can lead to new charges.
  • Be careful about speaking with investigators, CPS caseworkers or the accuser’s family before you understand your options.

If you’re worried about someone close to you, the same steps apply. Do not guess about what was said or what the report claims. Get the facts from the official papers.

What about a charge for making a false report?

Some people ask whether the accuser can be charged with making a false report to police. Charges for making a false report are likely to be referred to another firm. Our focus is defending the person accused of a sex crime, aggravated assault or family violence.

Frequently asked questions

Can I be charged in Texas based only on someone’s accusation?

Yes. The defense can test the accusation against the rest of the evidence.

Will the case be dropped if the accuser recants?

Not automatically. A recantation is one piece of evidence that prosecutors and the court may consider.

Should I tell police my side of the story?

Statements made without a plan can be repeated later and read in a different light. Talking with a lawyer first helps you understand your options.

Can I contact the accuser to sort it out?

Contact may violate bond conditions or a protective order, and it can lead to new charges. Follow every court order exactly.
