Sex Crime Defense for Rosenberg and Fort Bend County Residents

Barbieri Law Firm defends people accused of sex crimes and assaultive offenses across Texas. A sex crime lawyer at Barbieri Law Firm, based in Frisco, Texas, can review your charge.

Rosenberg is the county seat of Fort Bend County. The firm serves clients across Texas from its Frisco office.

This page is for adults who have been arrested, charged, investigated or contacted by police about a sex crime, assaultive offense or online sex offense. It is also for the partner, parent or family member helping decide whether to hire a criminal defense lawyer.

Whether a charge leads to a conviction depends on how the case proceeds. The early stages matter most, while bond, evidence and the charging papers are still open. Many people feel pressure to answer questions or sign papers right away. A short call can help you understand what the paperwork says before you make decisions.

To talk through where your case stands today, call (972) 424-1902.

Sex Crime and Assaultive Charges the Firm Defends

The firm defends sex crimes, aggravated sexual assault, child sex crimes, online sex crimes, aggravated assault and family violence. Each charge has its own elements, so the exact label matters.

  • Aggravated sexual assault. This is a first-degree felony. A 25-year minimum term applies in certain cases, such as when the victim is younger than 10. Texas Penal Code § 22.021
  • Indecency with a child. Sexual contact is a second-degree felony. Exposure is a third-degree felony. The statute also sets out affirmative defenses. Texas Penal Code § 21.11
  • Unlawful disclosure of intimate visual material. This is a state jail felony. The statute says it is not a defense that the depicted person created the material or agreed to its creation. Texas Penal Code § 21.16
  • Aggravated assault. Assault becomes aggravated when it causes serious bodily injury or involves a deadly weapon. Texas Penal Code § 22.02
  • Family violence. The Family Code covers certain acts by a family or household member, and threats that cause fear of imminent harm. Defensive measures to protect yourself are excluded. Texas Family Code § 71.004
  • Indecent exposure. The base offense is a Class B misdemeanor. Repeat offenses can be charged at higher levels. Texas Penal Code § 21.08

Some cases start before any charge. Suspected online child exploitation can be reported to NCMEC’s CyberTipline, and NCMEC refers tips to law enforcement for possible investigation. A child abuse allegation can also trigger a separate state investigation, as the Texas DFPS investigation guide explains. Whatever the label, reviewing the actual charging document is the first step.

How a Texas Sex Crime Case Typically Moves

A typical case starts with a contact, moves to a case review, and ends with a decision about representation.

  1. Contact. Call (972) 424-1902 or send your case details through the contact form.
  2. Free initial consultation. The initial consultation is free, confidential and carries no obligation to continue.
  3. Case review. Bring the charging papers, bond paperwork, police reports and any digital evidence. The lawyer reviews them with you.
  4. Options. The lawyer explains the paths forward and what each one involves. No honest lawyer can predict how a case will end.
  5. Representation decision. If you hire the firm, the scope of work is explained in writing before work begins.

Texas cases generally move through arrest or charge, bond, arraignment, pretrial work and resolution. Court schedules vary by county and by case, so no fixed timeline applies. Resolution can include deferred adjudication community supervision.

Many people wait for a court date before calling. Early review can help with bond conditions and with keeping messages, phone data and other evidence intact.

Texas Sex Offender Registration and What It Can Mean

Registration applies only in certain cases.

Texas sets registration rules in Chapter 62 of the Code of Criminal Procedure. Its Chapter 62 definitions include a “sexually violent offense.” Each listed offense counts only when committed by a person 17 years of age or older. Indecency with a child by sexual contact, sexual assault and aggravated sexual assault are on that list when committed by a person 17 years of age or older.

Don’t assume it does or doesn’t apply to your charge. Ask the lawyer early whether registration could apply, so you can plan around the answer.
